What recourse might be available if I have a vehicle that might be improperly repaired?
Option 1: Seek a qualified shop that specializes in post repair inspections: Have them look the vehicle over and make a list of all items that must be corrected. The reinspector will usually list the defects and flaws in order of importance. I.E. Safety Issues, cosmetic issues etc. There will probably be a small fee for this type of documentation, but it can be well worth it in the end. The more documentation you have, the easier it will be to plead your case.
Option 2: Take your documentation to the shop that repaired your vehicle and ask them how much they will reimburse you to have your car re-repaired at the re-repair facility. Most likely the original shop will not want to do anything at all. At this time you might want to involve the insurance company that was responsible for payment at the time your car was repaired. If the insurer wrote their own estimate initially, the there may be some type of liability on their part for the poor repair. In other words, if the insurer dictated how the vehicle should be repaired, then that mandate may have contributed to the substandard repair. Ask the insurer and the shop to respond to your questions in writing, so that there will be no misunderstanding among any of the parties. Option 3: You may want to file a comprehensive claim with your own insurance company for the malicious mischief and mechanic's negligence that damaged your car in the form of poor repairs. The negligence of the insurance appraiser may also be a contributing cause of this negligence.You may want to seek some advice from an attorney
Option 4: You may want to file a small claims action, depending on the maximum that the court has set in your state.
